2025, the Canary Islands Parliament ratified Decree-Law 2\/2025 of 17 March on urgent measures relating to the obligation to comply with tourist use and amending Law 2\/2013 of 29 May on the renewal and modernisation of tourism in the Canary Islands, and its Regulations, approved by Decree 85\/2015 of 14 May, establishing itself as a complement to the measures already adopted by the Government of the Canary Islands regarding the housing emergency, and with the aim of not exacerbating the problem of the shortage of housing for permanent residence in tourist areas.<\/p>\n<p>Decree-Law 2\/2025 repeals Article 24 of Law 2\/2013 of 29 May on the renewal and modernisation of tourism in the Canary Islands, which regulated the declaration of non-compliance with actual use and allowed for the sanctioning of owners who did not respect the tourist use of their properties.<\/p>\n<p>This repeal is based on the fact that the measure was disproportionate and completely out of touch with current urban planning realities, and did not fit within the appropriate course of action expected of public authorities in matters of urban planning.<\/p>\n<p>In line with the aforementioned repeal of the declaration of non-compliance with actual use, certain amendments are introduced to Law 2\/2013 and its Regulations, approved by Decree 85\/2015 of 14 May.<\/p>\n<p><strong>Specific measures adopted to redirect the residentialisation of tourist establishments.<\/strong><\/p>\n<ul>\n<li><b><strong>Change of use to residential<\/strong><\/b><\/li>\n<\/ul>\n<p>With the fundamental aim of alleviating the shortage of permanent residential housing in tourist areas, this decree incorporates and regulates measures relating to existing buildings and the change of use from tourist to residential.<\/p>\n<p>To achieve this objective, a maximum period of three years is granted so that owners of tourist buildings for which continued use as tourist accommodation is unviable (among other reasons, for example, due to the residentialisation of the tourist establishment, which is difficult to reverse) may apply to the local council to change the use of such buildings to residential.<\/p>\n<ul>\n<li><b><strong>Suspension of penalty proceedings<\/strong><\/b><\/li>\n<\/ul>\n<p>Upon applying for the change of use to residential, the Regional Ministry of Tourism may be requested to suspend penalty proceedings relating to residential use in tourist areas, which will result in their automatic suspension as well as the interruption of the limitation periods for the infringements and penalties corresponding to the penalty proceedings initiated.<\/p>\n<p>This suspension lasts for six months, extendable to a maximum of three years depending on the stage of processing of the relevant town planning instrument.<\/p>\n<ul>\n<li><b><strong>Prohibition on the tourist use of dwellings<\/strong><\/b><\/li>\n<\/ul>\n<p>Finally, for the sake of consistency, it is strictly prohibited for the new residential use to allow for any form of tourist exploitation of the resulting dwellings, which has significant implications for holiday homes.<\/p>\n<\/div>\r
