The Third Chamber of the Supreme Court has handed down a landmark ruling on housing, tourism and the division of powers between the State and the Autonomous Communities,<\/b> partially upholding the appeal lodged by the Valencian Regional Government against Royal Decree 1312\/2024, which regulates the Single Tenancy Register and the creation of the Single Digital Tenancy Portal for the collection and exchange of data relating to short-term accommodation rental services.<\/p>\n

The judgment partially upholds the appeal, annulling several key articles relating to the creation of the Single Tenancy Register<\/b>; and dismisses it in respect of the provisions governing the Digital Single Tenancy Window and the obligation for online platforms to transmit and exchange data, a regulation which remains in force.<\/b><\/p>\n

The Supreme Court takes as its starting point the legal, economic and social context relating to short-term rentals and their effects.<\/p>\n

It notes that this situation led the EU to adopt Regulation 2024\/1028 with the aim of establishing \u201charmonised rules<\/i>\u201d regarding the registration system and the requirements for exchanging data with online short-term rental platforms.<\/p>\n

The contested Royal Decree states that it was published in application of the European Regulation. However, the Supreme Court considers that this is not the case since, although the European regulation does not in any way specify that the registration procedure established in a Member State must be of a national nature.<\/p>\n

The central issue in the proceedings was to determine whether the State had the competence to create a mandatory state procedure, linked to the Land Registry and the Register of Movable Property, requiring the obtaining of a registration number to operate on online platforms, on which the Supreme Court ruled in the negative.<\/p>\n

The judgment concludes that the State lacks sufficient legal basis to regulate the single registration procedure designed in the Royal Decree. In the Chamber\u2019s view, the State regulation encroaches on areas where the Autonomous Communities already exercise their own powers \u2013 in housing and tourism \u2013 through pre-existing regional registers<\/b>.<\/p>\n

The analysis of the European Regulation is of particular importance: the Court notes that EU legislation neither requires a centralised state model nor alters the internal distribution of powers. On the contrary, it allows for the coexistence of different registration procedures provided there is coordination and duplication is avoided.<\/p>\n

Consequently, the provisions relating to the single register procedure and the obligation to register in the registers as a requirement for offering short-term rentals on digital platforms are annulled.<\/b><\/p>\n

However, the Supreme Court ruling validates the regulation of the digital one-stop shop for rentals, as well as the obligations regarding data transmission and processing, under state jurisdiction, facilitating interoperability between administrations.<\/b><\/p>\n

This ruling establishes an important principle: state control and coordination of short-term rentals are constitutionally permissible, but not by replacing existing regional registers.<\/p>\n

Further rulings from the Chamber are expected, as other autonomous communities such as the Canary Islands and Andalusia have also appealed against this Royal Decree.<\/p>\n
