The Independent Whistleblower Protection Authority (AIPI, its Spanish acronym), which began operating on 1 September 2025, has now enabled the form for informing the identity of the person responsible for the Internal Information System, which can be accessed via the following link: https:\/\/sede.proteccioninformante.gob.es\/login\/index\/idp\/1<\/a><\/p>\n

One of the key aspects that companies bound by Law 2\/2023 of 20 <\/u>February<\/u>, regulating the protection of persons who report regulatory violations and in the fight against corruption (Law 2\/2023), must address is the obligation to inform the AIPI\u2014or to <\/span>the competent authority of their autonomous community, as appropriate\u2014the identity of the person responsible for the internal information system (Article 8.3 of Law 2\/2023).<\/p>\n

Royal Decree 110\/2024, which regulates the functioning of the AIPI, incorporated a transitional provision extending the initial deadline for making this communication from ten days to two months. With the form now enabled, the AIPI has announced that this two-month period will begin today, 10 February 2026.<\/p>\n

The AIPI has also published a specific manual to guide obligated companies in the correct completion and submission of this notification, facilitating compliance with this administrative procedure.<\/p>\n

This manual is in addition to the three<\/u> previous recommendations published by the AIPI; all these documents can be found at the following link: Circulares, Recomendaciones y gu\u00edas – proteccioninformante.es<\/a><\/p>\n

This new regulatory scenario requires companies not only to meet deadlines and formal procedures, but also to ensure that their internal information systems are fully aligned with the principles of confidentiality, integrity, and protection against retaliation, as established by law.<\/p>\n

Adapting to these regulatory requirements should not be seen solely as compliance with a legal obligation, but as an opportunity to strengthen an organizational culture based on integrity, transparency, and the principles of good corporate governance.<\/p>\n<\/div>\r
